These Terms of Service ("Terms") govern your use of the MyMemberForge platform ("Service"), operated by MyMemberForge ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

MyMemberForge is a membership management platform designed for martial arts schools and fitness organizations. The Service includes member management, class scheduling, attendance tracking, billing and invoicing, communications (email and SMS), prospect management, and related administrative tools.

2. Accounts

To use certain features of the Service, you must create an account. You are responsible for:

• Providing accurate and complete information during registration
• Maintaining the security and confidentiality of your login credentials
• All activities that occur under your account

You must notify us immediately if you become aware of any unauthorized use of your account.

3. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Send unsolicited or unauthorized advertising, spam, or bulk messages through the Service
• Attempt to gain unauthorized access to any part of the Service, other accounts, or systems
• Interfere with or disrupt the Service or the servers and networks connected to it
• Use the Service to collect, store, or process sensitive personal information beyond what is necessary for membership management
• Impersonate any person or entity or misrepresent your affiliation

4. SMS/Text Messaging Terms

By opting in to SMS notifications through the Service, you agree to the following:

• You consent to receive recurring text messages from the school or organization you are associated with, sent through the MyMemberForge platform
• Messages may include class reminders, schedule changes, payment confirmations, billing alerts, membership updates, rank promotions, and school announcements
• Message frequency varies based on your activity and your school's communication practices
• Message and data rates may apply depending on your mobile carrier and plan
• You may opt out at any time by replying STOP to any message or by disabling SMS in your account settings
• Reply HELP to any message for assistance
• SMS consent is not a condition of membership enrollment or any purchase
• We will not share your phone number or SMS opt-in information with third parties for marketing purposes

5. Billing and Payments

If your school uses the billing features of the Service:

• Payments are processed securely through Stripe, a PCI-compliant third-party payment processor
• You authorize recurring charges for active membership plans unless cancelled
• Membership fees, pricing, and billing terms are set by your individual school or organization
• Refund policies are determined by your school; please contact them directly for refund requests
• We are not responsible for disputes between you and your school regarding membership fees

6. Intellectual Property

The Service, including its design, features, code, and content, is owned by MyMemberForge and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

7. Content and Data

You retain ownership of any data you provide to the Service. By using the Service, you grant us a limited license to process, store, and display your data as necessary to provide the Service. School administrators are responsible for the accuracy and legality of the data they input, including member information.

8. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. Your school administrator may also deactivate your account. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will do so.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MYMEMBERFORGE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless MyMemberForge, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

13. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
