# RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT **PLEASE READ CAREFULLY — THIS IS A LEGALLY BINDING AGREEMENT.** In consideration of being allowed to participate in martial arts, self-defense/self-protection programs, fitness training, firearms training/shooting, use of exercise equipment, and related activities (collectively, the "Activities") offered by Confluence Krav Maga, LLC, Richard D. Franklin, J. Michael Berentz, and any of their affiliated training centers, facilities, officers, instructors, agents, contractors, and employees (collectively, "CKM"), I agree to the following: ## 1. Voluntary Participation and Assumption of Risk I understand and acknowledge that participation in the Activities involves inherent risks, including but not limited to physical exertion, contact with others, use of weights, machinery, apparatus, and other training equipment, and the potential for injury, illness (including communicable disease), property loss, or even death. I voluntarily assume all risks, known and unknown, associated with participation in the Activities, whether on CKM premises or at an off-site location. ## 2. Physical Condition and Medical Authorization CKM urges me — and all students — to obtain a physical examination from a physician before using any exercise equipment or participating in any class or training session. I affirm that I am in good physical condition and do not suffer from any medical condition that would prevent or limit my participation. I consent to receive medical treatment deemed necessary if I am injured or require assistance, and I understand that I am responsible for any related costs. ## 3. Responsibility for Equipment and Program Selection I understand that all exercises, including the use of weights and the use of any and all machinery, equipment, and apparatus designed for exercising, are undertaken at my sole risk. I understand that the decision to participate in, and the selection of, any exercise program, method, or type of equipment is entirely my own responsibility, and that CKM shall not be liable to me for any claims, demands, injuries, damages, or actions arising out of or in connection with my use of the services, facilities, equipment, or premises of CKM. ## 4. Waiver and Release of Liability I, on behalf of myself, my heirs, executors, personal representatives, assigns, and any minors in my care or control, hereby waive, release, and forever discharge CKM, its owners, managers, officers, employees, instructors, agents, contractors, affiliates, and volunteers from any and all claims, demands, damages, actions, or causes of action, of any kind or nature, whether in law or equity, arising out of or related to my participation in the Activities or my use of CKM facilities, equipment, and services. This waiver and release applies to all claims, including those arising from the negligence (but not the gross negligence or intentional misconduct) of CKM or any third party. ## 5. Indemnification I agree to indemnify, defend, and hold harmless CKM from any loss, liability, damage, or cost, including attorney's fees, resulting from my participation in the Activities or my presence on the premises, or that of any minor accompanying me. ## 6. Binding Effect and Governing Law This Agreement shall be governed by the laws of the State of Illinois. If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. I agree that any legal action arising out of this Agreement must be brought in a court of competent jurisdiction in Madison County, Illinois. ## 7. Acknowledgment of Understanding **I HAVE READ THIS RELEASE OF LIABILITY, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.** If signing on behalf of a minor child, I certify that I am the legal parent or guardian of that child, and I voluntarily provide this release on their behalf.
